A brand is a trademark. It can be a word, design, slogan, color and even a sound that is used to distinguish goods (e.g. Apple for computers or Harley Davidson for motorcycles) or services (e.g. Google for search engine services or Beatles for a musical group). Trademarks can be registered in a variety of classes.  For example, "Starbucks" is federally registered for restaurant services, clothing, mugs, newsletters and, of course, coffee.

Begin with a FREE consultation and then hire us to assist you with the research, review and filing of your valuable brand with the U.S. Patent and Trademark Office (USPTO).

Consultation

  • We provide a FREE initial consultation to discuss your trademark budget, goals and needs. (30 min)

  • Moving forward you then sign an engagement letter and pay the related fee to get started.

  • We will review potential classes and strategies for searching and filing your trademark(s).

Research

  • We provide 2 search options. The first is our "in-house search" of the USPTO database (U.S. Federal Trademarks Only) to determine availability of proposed trademark(s). 

  • It is also recommend that you order a "full search" to confirm nationwide availability. (Includes U.S. Federal, all 50 states trademark registries, business names, domain names, etc.). 

Review

  • We review search results with you for potential conflicts to registration.

  • If the search is clear, we move to then next step.

  • If there are conflicts, we consult with you about the options.

Filing

  • Prepare trademark application for review and, following client’s approval, file with the USPTO. 

  • Once the application is submitted it is then reviewed by a USPTO Trademark Examiner. This process can take up to 9 months.

  • Filing a trademark application with the USPTO does not guarantee that the trademark will be approved and registered, but our goal is to help identify and navigate potential barriers prior to filing.
